Terms of Use for KEZY 100+ Games

These Terms of Use ("Terms") govern your access to and use of KEZY 100+ Games, the kezy.games website, the progressive web app ("PWA"), and any related channels, feeds, push notifications, or promotional placements (collectively, the "Services"). The Services host browser-based games supplied by licensed developers, monetise gameplay through advertising, and allow optional notifications for new releases. By accessing or using the Services you agree to be bound by these Terms and our Privacy and Cookie Policies. If you do not accept these Terms, you must stop using the Services immediately.

1. About KEZY
KEZY is operated by KEZY 100+ Games ("KEZY", "we", "us", "our"), headquartered in Casablanca, Morocco. Our mission is to curate a safe, policy-compliant gaming experience that respects the Google Play Developer Program Policies, Google Ads and Ad Manager policies, applicable consumer protection laws, and intellectual property rights of our partners.

2. Eligibility and Access
• The Services are intended for users aged 13 and older. If you are between 13 and the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.
• The Services do not require registration or payment credentials; access is provided on an "as-is" basis for personal, non-commercial entertainment.
• Certain features (for example, push notifications) may require you to grant specific device permissions. You can revoke those permissions at any time in your device or browser settings.

3. Description of the Services
• KEZY hosts HTML5 and instant games created by licensed publishers. Gameplay occurs directly in your browser or via the PWA.
• Advertising is displayed through Google AdSense / Ad Manager and approved mediation partners. Ads may be contextual or personalised in accordance with your consent and regional regulations.
• Optional push notifications and newsletters (if made available) provide updates on new games, tournaments, or platform improvements.
• The Services may include community features such as ratings, leaderboards, or feedback forms. These features must be used responsibly and in compliance with these Terms.

4. Acceptable Use
You agree to use the Services only for lawful purposes and in a manner consistent with the Google Play Developer Program Policies, Google Ads policies, and applicable legislation. You must not:
• engage in illegal, fraudulent, or harmful behaviour;
• upload, transmit, or share content that is defamatory, obscene, hateful, sexually explicit, or otherwise violates Google content standards;
• interfere with or disrupt the integrity of the Services, servers, or networks (including attempting to introduce malware, automated scripts, or denial-of-service attacks);
• attempt to reverse engineer, decompile, or otherwise extract source code or proprietary algorithms;
• engage in invalid ad activity, including generating fraudulent impressions or clicks, or encouraging others to do so;
• circumvent content filters, geographic restrictions, or security controls;
• harvest or collect personal information about other users without consent;
• impersonate another person or misrepresent your affiliation with KEZY or any other entity.
KEZY may monitor usage patterns, log IP addresses, and cooperate with partners or authorities to investigate suspicious activity.

5. Intellectual Property
• All platform code, design assets, trademarks, logos, and brand elements are owned by KEZY or our licensors.
• Hosted games remain the intellectual property of their respective developers. KEZY displays them under licensing agreements that allow streaming or embedding. You receive a limited, revocable licence to play the games for personal entertainment.
• You may not reproduce, modify, distribute, publicly display, or create derivative works from KEZY content without written permission.

6. User Contributions
KEZY may invite you to submit feedback, bug reports, survey responses, or community comments. By submitting content you grant KEZY a worldwide, royalty-free licence to use, reproduce, modify, publish, and translate the content for the purpose of operating and improving the Services. You remain responsible for ensuring that your submissions do not infringe third-party rights or violate these Terms.

7. Third-Party Games and Links
The Services contain links to games, assets, and landing pages operated by external parties. These third-party sites have their own terms and privacy policies. KEZY does not control and is not responsible for their practices, availability, or performance. If you choose to engage with third-party offers (for example, installing an external app), you do so at your own risk and should review the applicable policies carefully.

8. Advertising and Monetisation
• KEZY displays advertisements to keep the Services free. We work with Google ad products and other certified demand partners. Ads must not be altered, obscured, or interacted with in an automated or deceptive manner.
• We may use contextual signals (such as the game you are playing) or pseudonymous identifiers to deliver relevant ads, always within the bounds of user consent and applicable laws.
• Offers presented in ads are the responsibility of the advertiser. KEZY is not liable for third-party promotions, purchases, or outcomes. Always read the terms provided by the advertiser before engaging.

9. Push Notifications and Communications
• Push notifications are opt-in. By enabling them, you agree to receive updates related to KEZY content. You can opt out at any time through your device or browser settings.
• KEZY may also send service announcements (for example, maintenance notices) as needed. We do not send unsolicited SMS messages or collect phone numbers.

10. Updates, Maintenance, and Availability
KEZY may update the Services, games, or policies at any time to maintain compliance with Google or legal requirements, improve performance, or add new features. We strive to minimise downtime but do not guarantee uninterrupted, error-free access. Scheduled maintenance or unforeseen outages may occur without prior notice.

11. Suspension and Termination
KEZY reserves the right to suspend or terminate access to the Services for any user who violates these Terms, engages in fraudulent or abusive behaviour, or poses a risk to the platform or its partners. We may also remove specific games or features in response to policy changes or partner requests. Upon termination, your permission to use the Services ends immediately.

12. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. KEZY disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and freedom from computer viruses. We do not warrant that the Services will meet your expectations, that gameplay will be uninterrupted, or that defects will be corrected.

13. Limitation of Liability
To the fullest extent permitted by law, KEZY, its affiliates, officers, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, goodwill, data, or other intangible losses arising from your use of the Services. Our total liability for any claim is limited to the amount you paid (if any) for access to the Services in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not permit certain limitations of liability; in such cases our liability is limited to the minimum extent allowed by law.

14. Indemnification
You agree to indemnify, defend, and hold harmless KEZY and its affiliates from any claims, damages, obligations, losses, liabilities, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any third-party right.

15. Privacy
Your use of the Services is also governed by our Privacy Policy and Cookie Policy, which detail how we handle information and cookies. By using the Services you acknowledge these policies.

16. Changes to the Terms
We may update these Terms to reflect new functionality, legal requirements, Google policy updates, or operational changes. The "Last Updated" date will indicate the latest revision. When changes are material we will provide notice (for example, a banner, push notification, or email where possible). Continued use after the effective date constitutes acceptance of the revised Terms.

17. Governing Law and Dispute Resolution
These Terms are governed by the laws of Morocco without regard to conflict of laws principles. Any dispute shall be submitted to the competent courts of Casablanca, Morocco, unless applicable consumer protection laws require a different venue. Before filing suit, you agree to contact KEZY to seek an amicable resolution.
